I second venomouslobster and the rest here, I think that the photographer has the right to the photograph, not Square Enix. That's like saying the picture of you and Mickey Mouse that you took at Disneyland is property of Disney.

Additionally, though it was only stated in the title of the thread, it's a picture of a cosplayer! It is not the actual character, therefore they have no legal claim at all. The cosplayer in the picture may, but not Square Enix.
